Terms and Conditions

Please read these Terms and Conditions (“Terms,” “Agreement”) carefully before using cali4niausa.com (the “Site”) or purchasing any product offered by CALI4NIA (“CALI4NIA,” “we,” “us,” or “our”). By accessing the Site, creating an account, or placing an order, you agree to be bound by this Agreement. If you do not agree to these Terms, please do not use the Site.

1. Acceptance of Terms

By using this Site, you certify that you have read, understood, and agree to comply with these Terms. CALI4NIA grants you a limited, revocable, non-transferable license to access and use the Site and to purchase products for your personal, non-commercial use, conditioned on your acceptance of this Agreement. If you do not want to be bound by these Terms, you must stop using the Site.

2. Privacy Policy

Your use of the Site is also governed by our Privacy Policy, available at cali4niausa.com/privacy-policy, which describes how we collect, use, and protect your personal information. By using the Site, you consent to the data practices described there.

3. Products, Pricing & Availability

We make every effort to display our shirts, graphics, and colors as accurately as possible, but we do not guarantee that your device's display will render colors, textures, or print placement with complete accuracy. Minor variations between the product shown online and the item received (including slight print or color differences between production runs) are normal and are not considered defects.

All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to limit quantities, discontinue any design or size, correct pricing or listing errors (including after an order has been placed), and refuse or cancel any order at our sole discretion. If we cancel an order after payment has been charged, you will receive a full refund of the amount paid for that order.

4. Orders & Payment

Placing an order through the Site is an offer to purchase, which we may accept or decline. A contract of sale is formed only when we confirm and ship your order. We accept the payment methods presented at checkout; by submitting payment information, you represent that you are authorized to use the payment method provided.

You are responsible for providing an accurate shipping address, size selection, and contact information. CALI4NIA is not responsible for orders delayed, misdelivered, or lost due to incorrect information provided at checkout.

5. Shipping

Orders are processed and shipped from our own inventory within the timeframe stated on the Site at checkout, excluding weekends and holidays. Shipping and handling fees, carrier, and estimated delivery times will be shown before you complete your purchase. Delivery dates are estimates only; CALI4NIA is not liable for delays caused by the carrier, customs, weather, or other events outside our reasonable control.

Risk of loss and title for items purchased pass to you upon our delivery of the product to the shipping carrier. If your order arrives damaged or is lost in transit, contact us at the email below and we will work with you to resolve the issue.

6. Returns, Exchanges & Refunds

We want you to be happy with your CALI4NIA gear. You may return or exchange eligible items within 30 days of the delivery date, provided the item is unworn, unwashed, undamaged, and returned with all original tags attached.

● Return shipping costs are the customer's responsibility unless the item is defective, damaged on arrival, or we shipped the wrong item.

● Refunds are issued to the original payment method within 5–10 business days of our receiving and inspecting the returned item.

● Sale, clearance, and items marked “Final Sale” at checkout are not eligible for return or exchange.

● To start a return or exchange, contact us at the email below with your order number.

7. Intellectual Property

All designs, graphics, slogans, logos, product photography, and other content on this Site are the property of CALI4NIA, its licensors, or its suppliers, and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any CALI4NIA design or content, including printing it on other apparel or merchandise, without our prior written consent.

If you submit or upload any content to the Site (for example, a product review or photo), you grant CALI4NIA a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and distribute that content in connection with promoting and operating our business.

8. User Accounts

If you create an account with us, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts, remove content, or cancel orders at our sole discretion, including where we suspect fraud or a violation of these Terms.

9. Prohibited Conduct

When using the Site, you agree not to:

● Use the Site for any unlawful purpose or in violation of these Terms;

● Resell CALI4NIA products without our prior written authorization;

● Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its systems;

● Use automated means (bots, scrapers) to access or copy content from the Site without permission.

10. Disclaimer of Warranties

The Site and all products are provided “as is” and “as available.” To the fullest extent permitted by law, CALI4NIA disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the fullest extent permitted by law, CALI4NIA and its officers, employees, and agents will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or products, even if advised of the possibility of such damages. Our total liability for any claim arising from your order will not exceed the amount you paid for the product giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless CALI4NIA, its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use or misuse of the Site, your violation of these Terms, or your infringement of any third-party right.

13. Applicable Law

These Terms, and any dispute arising from your use of the Site or purchase of our products, are governed by the laws of the State of California, without regard to its conflict-of-laws principles.

14. Disputes

Any dispute related to your use of this Site or products purchased from us will be resolved in the state or federal courts located in California, and you consent to the exclusive jurisdiction and venue of those courts.

15. Changes to These Terms

CALI4NIA reserves the right to edit, modify, or update this Agreement at any time. Material changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. This Agreement supersedes all prior agreements regarding your use of the Site.
